General Terms and Conditions (Pirate Boat Sinbad) Family Boat Trips (Cancellation policy not applicable for Fuikdag, see below)
1. General
When making a reservation, you must agree to and abide by the terms and conditions set by Family Boat Trips, and you must inform all participants in your group of these terms and conditions.
2. Liability
2.1. Family Boat Trips is under no circumstances liable for any (in)direct damage and/or loss caused by the activities or otherwise due to failure.
2.2. Family Boat Trips is under no circumstances liable for damage suffered by third parties during the activity.
3. Safety
3.1. Participants declare that they are aware of their participation in the activities and that the activities involve risks, including injury and damage to property due to weather conditions.
3.2. By acknowledging these risks, the participant expressly accepts these risks when using and participating in Family Boat Trips services and activities and agrees that these risks are at their sole expense.
3.3. When participating in activities on the ships, the participant is informed that a life jacket is available for each passenger to be worn throughout the activity.
3.4. Participants must inform Family Boat Trips of any food allergies/intolerances and other conditions that may cause health problems prior to the activity. The participant agrees that consuming food and beverages is entirely at his own risk.
4. Participants are not allowed:
• Touching equipment, ropes, or any part of the vessel without permission from the Family Boat Trips crew.
• Entering crew-only areas, even if there is no door, such as the kitchen.
• Jumping off the boat without permission from a Family Boat Trips crew member.
• Exhibiting dangerous behavior or causing obstacles for fellow participants, Family Boat Trip crew members and/or other vessels.
• Taking or using drugs, dangerous substances and/or weapons during the activity.
• Excessive use of alcohol.
5. Requirements
5.1. The participant must at all times, especially in the event of an emergency, follow the directions and/or instructions of the Family Boat Trips crew as best as possible.
5.2. Family Boat Trips is at all times entitled to refuse entry to participants or to discontinue the activity in violation of the rules set out under "Safety", in which case the participant will under no circumstances be entitled to a refund or compensation.
5.3. All participants must be physically fit and able to swim to make a reservation or inform Family Boat Trips if not.
5.4. Any participant who does not arrive on time for the scheduled activity will be considered a NO SHOW.
6. Cancellation
6.1. All cancellations must be sent and confirmed by email to Family Boat Trips at the following address: info@pirateboat-curacao.com.
6.2. If Family Boat Trips does not reach the required minimum number of passengers for a tour, you will be offered an alternative date or a full refund.
6.3. Cancellations for our regular activities with more than 48 hours notice will receive a 100% refund.
6.4. Cancellations with less than 48 hours notice are non-refundable.
6.5. Private charters or rentals are refundable with 14 days' notice.
6.6. Private charters or rentals are 50% refundable with 7 days' notice.
6.7. Private charters or rentals are non-refundable with less than 7 days notice.
6.8. No show = No refund
6.9. Family Boat Trips reserves the right to cancel your reservation for violations of our policies.
7. Weather policy
Family Boat Trips does not depart in unsafe weather conditions. The captain will assess the weather and if he or she determines that conditions are unsafe to start or continue the activity, the activity may be stopped, postponed or canceled. Family Boat Trips will make every effort to reschedule your activity during your stay. If you are unable to reschedule, you have the option of receiving a partial or full refund.
8. Customer service
Family Boat Trips continuously improves its ships to better serve its customers. That said, our pricing may change from time to time based on these improvements. We understand that this may result in outdated prices on our flyers and posters. For current pricing and equipment information, please see the website or Facebook page.
9. Other
9.1. Discounts only apply to Day and Sunset Trips and for direct booking.
9.2. Any variations to these terms must be in writing before they supersede any of the articles in these terms.
9.3. Under these conditions, the law of Curaçao applies to the agreement with the participant, all (other) services of Family Boat Trips and all disputes that arise between the participant and Family Boat Trips. In all cases, the court of Curaçao has exclusive jurisdiction to hear these disputes.
Cancellation policy for Fuikdag in January:
As a buyer you automatically agree to the terms and conditions. No refunds, no cancellations. 50% deposit and the remaining amount must be paid at least 2 weeks before Fuikdag. No refunds, no cancellations.
